Receiving a New Apartment in Israel: Warranty Periods and Snags

Summary

  • Starting point: the mandatory repair period (bedek, בדק) begins when the apartment is made available (art. 4 and the annex to the 1973 law).
  • Durations: 1 year for other defects, 2 years for carpentry and finishes, up to 7 years for detachment of the exterior cladding.
  • Warranty: 3 years after the end of the bedek period (art. 4(ג)).
  • Essential structural defect: a 20-year period (art. 4(א)(4)).
  • Burden of proof: during the bedek period, the developer must prove that the defect is not attributable to him.
  • Handover protocol: signing it does not waive hidden defects discovered later, according to a ruling cited by a law firm.

1. Handover Is Not the End of the Matter

Receiving the keys to a new apartment in Israel feels like an ending. In reality it is the beginning of a period during which the developer remains liable for what he has built.

That liability is not a commercial clause. It is set by the Sale (Apartments) Law of 1973 — חוק המכר (דירות), תשל"ג-1973 (Chuk HaMecher Dirot) — and by its annex. It distinguishes several periods depending on the element concerned.

On the day of handover, you sign a protocol. That document matters, but it does not close off your rights. You need to know what it records, what it reserves and what it cannot make you lose.

2. The Starting Point: When the Apartment Is Made Available

The mandatory repair period, called bedek (בדק), begins when the apartment is made available (art. 4 and the annex to the 1973 law). So it is not the date the contract was signed: it is the moment the apartment is placed at your disposal.

That distinction matters for the calculation. The starting point remains the making available; the snag list documents the condition of the apartment on that date.

In practice, note the exact handover date and keep the protocol and every exchange that comes with it. That date will be the reference for years.

3. The bedek Periods, Element by Element

The annex to the law sets different periods depending on the nature of the defect. The table below sets out the periods provided.

ElementDuration of the bedek period
Other defects1 year
Carpentry, tiling and finishes2 years
Water heater and equipment, insulation, courtyard3 years
Pipes, waterproofing4 years
Cracks wider than 1.5 mm (non-structural)5 years
Detachment of the exterior cladding7 years

Each defect attaches to the period corresponding to the element concerned. A tiling defect falls within the 2-year period, a non-structural crack wider than 1.5 mm within the 5-year period, exterior detachment within the 7-year period.

The table must therefore be read element by element, not as a whole. One apartment can have several periods running at the same time.

4. The 3-Year Warranty That Follows the bedek

At the end of the bedek period, a 3-year warranty (achrayut, אחריות) applies (art. 4(ג)). It extends the developer's liability beyond the mandatory repair period.

The important point is the sequence. The warranty does not replace the bedek: it takes over when that period ends, and for a fixed term of 3 years. You therefore need to know at all times which period you are in; the answer depends on the element concerned and on the date the apartment was made available.

5. The Essential Structural Defect: 20 Years

The essential structural defect is subject to a separate period: 20 years (art. 4(א)(4)).

That exceptionally long period is explained by the nature of the risk. A structural defect affects the soundness of the building, and it may surface long after handover.

This is a point to discuss with a lawyer and an engineer if a serious problem appears.

6. Who Has to Prove What

During the bedek period, the burden of proof lies with the developer. It is for him to show that the defect is not attributable to him (law firm lt-law.co.il).

That rule changes the practical position. You report the defect, and the developer has to explain why he would not be liable.

Document defects as soon as they appear, with dated photographs and written exchanges.

7. The Handover Protocol and the Snag List

The handover protocol records the condition of the apartment on the day of handover. It lists the visible defects and the reservations you raise.

One question comes up often: does signing the protocol forfeit the right to claim later? According to a ruling cited by a law firm, signing it does not waive hidden defects discovered later.

The right practice is therefore to sign with precise, dated and documented reservations. A detailed protocol is worth more than a dispute on the day of handover.

8. The Independent Inspector

An independent inspector checks the apartment before or just after handover. His inspection covers in particular waterproofing, plumbing, windows, tiling and the mamad. The defects found are noted in the protocol.

His value lies in producing a technical survey at the moment when the burden of proof still rests with the developer. A dated report, with photographs, is useful evidence if a disagreement arises.

9. Frequently Asked Questions

When does the developer's warranty period begin?

When the apartment is made available (art. 4 and the annex to the 1973 law). It is not the date of the contract.

How long does the warranty last after the bedek?

Three years after the end of the bedek period (art. 4(ג)). For an essential structural defect, the period is 20 years (art. 4(א)(4)).

Do I have to prove that the defect comes from the developer?

During the bedek period, no: the developer has to prove that the defect is not attributable to him (law firm lt-law.co.il).

Does signing the protocol make me lose my rights?

According to a ruling cited by a law firm, signing it does not waive hidden defects discovered later. Have a lawyer review the document.

What is an independent inspector for?

He checks waterproofing, plumbing, windows, tiling and the mamad, before or just after handover, and his findings are noted in the protocol. No fee scale or legal status is cited here; check locally.
