Buying an Apartment in Israel from France: Power of Attorney, Lawyer, Steps

Summary

  • Power of attorney: it is signed before an Israeli consul, or before a notary in France with an apostille.
  • Validity: a power of attorney signed abroad is valid if it complies with the law of the place of signature (art. 20(b) of the Notaries Law, according to a law firm).
  • Language: if the signatory does not read Hebrew, a certificate in a language he understands or a certified translation is required.
  • Apostille: Israel has been a party to the Hague Apostille Convention since 1978, according to gov.il.
  • Timeline: several months pass between signature and final registration.
  • Money: the 2000 anti-money-laundering law imposes identification obligations; the lawyer and the bank will ask about the source of funds.

1. What Changes When You Buy Without Being on Site

Buying a new apartment in Israel from France is not impossible. But physical absence shifts part of the work: what you would do in a single visit becomes a series of documents signed remotely.

The contract is in Hebrew. So are the technical annexes. Payments go through an Israeli banking circuit. And final registration requires tax certificates. Each of these points can block a file if it is handled too late.

The right method is to prepare three things before looking for a property: a clear mandate, an independent lawyer and a bank that has been warned. The rest follows a fairly stable order, which we describe below.

2. The Power of Attorney: What It Is Really For

The power of attorney (ייפוי כוח, yipui koach) is the document that allows one person to sign in your place.

It does not divest you of your property. It gives an agent the power to carry out defined acts, within the limits you set. The more precise the wording, the less the agent can go beyond what you intended.

That is why you should avoid powers of attorney drafted too broadly, of the "all powers relating to the purchase" type. Have it drafted by your lawyer.

3. Two Ways to Sign: Consul or Notary

The power of attorney can be signed in two ways. Either before an Israeli consul. Or before a notary in France, then with an apostille (Melnik law firm, 31/08/2026).

The first route is direct: the consul authenticates your signature within a framework recognised by Israel. The second goes through a French notary, then through the apostille that makes the document usable abroad.

The choice depends on your schedule and on the availability of each route. In both cases, the document must be ready before the signing date set in the contract.

4. The Apostille: The Formality to Plan For

The apostille is the formality that certifies the authenticity of a public document for use abroad. Israel has been a party to the Hague Apostille Convention since 1978, according to gov.il.

Without an apostille, a power of attorney signed before a French notary risks being refused in Israel. This is a point not to be neglected.

The practical rule is simple: have the power of attorney apostilled immediately after signature. Do not count on last-minute timing, especially if the contract signing date is already fixed.

5. The Language of the Document

A power of attorney signed abroad is valid if it complies with the law of the place of signature (art. 20(b) of the Notaries Law, according to the firm). But form is not enough: the signatory must also understand what he is signing.

If the signatory does not read Hebrew, a certificate in a language he understands is required, or a certified translation. Otherwise, the power of attorney risks being refused (Melnik law firm, 31/08/2026).

This point is often overlooked. A document signed in French before a notary, without translation or certificate, may be technically valid under French law and still risk being refused in Israel. The check must be made before signature, not after.

6. The Israeli Lawyer, Your Relay on the Ground

The Israeli lawyer is not a mere formalist. He checks the contract, the condition of the property, the guarantees and the payment circuit. He also represents you for the acts you cannot perform remotely.

One point deserves to be stated clearly: the developer's lawyer works for the developer. Your lawyer must be independent, chosen by you and paid by you. That is the condition for a genuinely adversarial reading of the contract.

Ask him for three things before signing: a written review of the delivery and guarantee clauses, verification of the bank guarantee, and a timetable of the acts to come. A lawyer who agrees to work without these three elements does not protect you.

7. The Money: Guarantee, Payments, Source of Funds

Payments in an off-plan purchase go through the bank guarantee and voucher booklet circuit. We detail this mechanism in our article on the bank guarantee in off-plan purchases. From France, the difficulty is organising the transfers at the right time, to the right account.

The 2000 anti-money-laundering law imposes identification obligations. The lawyer and the bank will ask you for the source of funds.

So prepare a source-of-funds file: originating accounts, proof of income, earlier sale deeds where applicable.

8. Tax Certificates and the Real Timeline

Tax certificates are required before registration. Several months must be allowed between signature and final registration (Melnik law firm, 31/08/2026).

This timetable must be built in from the start. It does not mean the file is blocked.

So anticipate two timetables: the construction one and the registration one. The second depends on tax documents, and it does not automatically follow the first. A lawyer can tell you where the file stands at each stage.

9. Frequently Asked Questions

Is a power of attorney mandatory to buy from France?

It becomes necessary as soon as an act must be signed in your absence: contract, amendments, bank documents.

Can the power of attorney be signed before a French notary?

Yes, provided an apostille is added (Melnik law firm, 31/08/2026). The other route is signature before an Israeli consul.

Must the power of attorney be translated into Hebrew?

If the signatory does not read Hebrew, a certificate in a language he understands or a certified translation is required. Otherwise, the power of attorney risks being refused.

How long does final registration take?

Several months may pass between signature and final registration (Melnik law firm, 31/08/2026). Tax certificates are required before registration.

Why am I asked about the source of my funds?

The 2000 anti-money-laundering law imposes identification obligations. The lawyer and the bank will ask for the source of funds before processing the transaction.
